The participation of a company in the state centralised procurement system requires bidding and being awarded the tenders that are called.
The procurement of supplies and services declared as centralised can be carried out through the following procedures:

Framework agreements: an agreement signed with one or several companies through the corresponding tender, establishing the conditions that the call-off contracts awarded during its term must follow. The award of these call-off contracts under a framework agreement may be made directly to one of its awarded companies or through a new tender in which only the awarded companies under the framework agreement may participate, according to its governing rules. Only companies awarded under a framework agreement may sign call-off contracts.
A company’s participation in call-off contracts therefore requires bidding and being awarded under the framework agreement itself, and subsequently being awarded the call-off contract, with or without a new tender.

The dynamic purchasing systems allow companies that meet the selection criteria to join the system throughout its validity period. The award of the specific contracts is made through a tender in which admitted companies in the dynamic system may participate.
A company’s participation in specific contracts therefore requires applying and being admitted to the dynamic system and subsequently participating in the tenders called for specific contracts and being awarded.
The Public Sector Contracts Law defines the conditions of capacity and solvency of companies in order to contract with the public sector, while each tender’s specifications define the specific conditions of economic and technical solvency.
